A lawyer who was prosecuted on charges of receiving money under the pretext of facilitating cases he had prosecuted while working as a prosecutor was sentenced to prison in the first trial.
On the 24th, Judge Lee Hwan-gi of the Criminal Division 4 at the Seoul Central District Court sentenced lawyer A, who was indicted without detention on charges of fraud and violation of the Attorney-at-Law Act, to three years in prison and ordered the confiscation of 260 million won. However, he was not taken into custody in court.
The judge pointed out, "Former prosecutor A deceived others by pretending to have influence through personal connections with investigative agencies, receiving money under the pretext of changing the prosecution's sentencing recommendation or suppressing investigations, which is a very serious offense. Such crimes cause public officials engaged in criminal justice work to be suspected of lacking fairness and lead to the wrongful perception that even legitimate investigation results are distorted achievements."
After retiring in July 2015, A met with individuals he had directly prosecuted and who were on trial, falsely claiming that he had exaggerated the prosecution's sentencing recommendation he had decided on and promised to "talk to the trial prosecutor to reduce the sentencing," thereby receiving 30 million won from a suspect under the pretext of a favor.
In addition, in September 2016, A was investigated for receiving 150 million won under the pretext of a favor from another suspect under prosecution, after deceiving them by saying, "This is a case where a well-known chief prosecutor is in charge. Personnel changes are about to happen."
