On the 18th, the prosecution requested a 5-year prison sentence for Don Spike, who was indicted for violating the Act on the Aggravated Punishment of Specific Crimes (psychotropic drugs) and other charges, at the second trial held before the Criminal Division 3 of the Seoul High Court (Chief Judge Lee Chang-hyung). The prosecution had also demanded a 5-year prison sentence in the first trial.
The prosecution explained the reason for the demand, saying, "The defendant is not sincerely remorseful," and "The defendant repeatedly committed the crime about 30 times over approximately 10 months and possessed an amount of methamphetamine sufficient for more than 3,000 uses." Furthermore, they added, "Although the defendant is a celebrity with significant influence on the public, he attempted to conceal his crimes by putting an accomplice in the forefront instead of himself," and "Considering that accomplices and other celebrities involved in similar cases were sentenced to imprisonment, the first trial's sentence of 3 years in prison with 5 years probation is too lenient."
In his final statement, Don Spike said, "Please consider that I immediately confessed to the crime upon arrest and actively participated in the investigation by providing detailed information, and that I have been striving to successfully reintegrate into society," adding, "I am sorry for committing a crime despite needing to be a model citizen. I deeply regret my wrongdoing, am reflecting on it, and will recover from addiction and act sincerely."
