Democratic Party Files Complaint for 'False Information Disclosure'... Prosecution Dismisses Case
Attorney Jang Young-ha, who was accused and reported for raising allegations of 'gangster involvement' against Lee Jae-myung, leader of the Democratic Party of Korea, but was dismissed by the prosecution, is now facing trial.
According to the legal community on the 2nd, the Criminal Division 30 of the Seoul High Court (Chief Judge Kang Min-gu) accepted the Democratic Party's request for reconsideration against the prosecution's dismissal of Attorney Jang on the 27th of last month.
A request for reconsideration is a system where, if the prosecution dismisses a complaint or accusation case, the relevant high court with jurisdiction over the prosecution's location reviews whether the decision was appropriate. If the court deems the dismissal unjust and accepts the request, the prosecution must file charges against the suspect.
Attorney Jang acted as the legal representative of Park Cheol-min, an operative of the violent organization 'Gukje Mafia-pa' active in Seongnam City, Gyeonggi Province. In October 2021, during the presidential election period, based on Park's statements, he conveyed to Rep. Kim Yong-pan of the People Power Party that Lee Jae-myung, while serving as mayor of Seongnam, received about 2 billion won under the condition of granting business favors to close associates of the Gukje Mafia.

The Democratic Party of Korea reported Park and Attorney Jang to the prosecution for violating the Public Official Election Act and other charges, claiming they publicized false information to prevent Lee's election. However, the prosecution dismissed the case, judging that Attorney Jang believed Park's statements to be true and reported the suspicions in good faith.
