There is growing interest in ways to securely pass on safe assets such as real estate, rather than unstable assets, to children for the efficient operation and management of family wealth.
Accordingly, legal advisory services related to asset management, including inheritance, gifts, and taxes, are increasing in the legal services market.
In line with this trend, Law Firm Sanha has launched a ‘Family Asset Planning Team’ composed of experts in inheritance, gifts, taxes, and real estate.
The Family Asset Planning Team is mainly composed of Attorney Kwak Nogyu (Judicial Research and Training Institute Class 43), who introduced Korea’s only heir care service, Attorney Lee Jaemin (Class 47), an expert in collective buildings, along with Attorneys Son Hyunjung (Bar Exam 8th), Lee Jiwon (8th), Jang Aram (9th), and Lee Junman (11th). In addition, tax experts and judicial scriveners within Sanha have joined the asset planning team, enabling comprehensive solutions for tax and registration issues.
The Family Asset Planning Team provides customized legal services tailored to client situations, such as when business succession is needed, stable management of inherited assets after death is required, safety measures must be established after gifting, tax savings are necessary during gifting and inheritance processes, or property management is needed during divorce or remarriage.
The team also handles consultations and litigation for issues arising after inheritance commencement, such as disputes among heirs, problems when gift conditions are not fulfilled, and issues that may arise with trust companies, managing overall family asset matters.
Especially given the overwhelming proportion of real estate in the assets held by domestic wealthy individuals, the Family Asset Planning Team’s strength lies in its construction and real estate experts who address real estate management and disposal issues.
In response to the growing interest in trust methods, the Family Asset Planning Team plans to increase collaboration with trust companies and financial institutions and to recruit additional tax experts to provide customized legal services.
Sanha has accumulated extensive experience in managing multi-family housing with complex stakeholder interests, defect litigation, and development projects such as reconstruction and redevelopment (maintenance projects). Furthermore, by establishing the ‘Apartment Legal Issues Research Institute,’ it provides comprehensive services from apartment construction to post-occupancy management, establishing itself as a leader in real estate and construction law firms.
