The Path Opens for 4·3 Victims' De Facto Children to Be Legally Recognized
Resolution of the Cabinet Meeting on the Enforcement Decree of the 4·3 Incident Act
The Ministry of the Interior and Safety announced that the amendment to the Enforcement Decree of the "Special Act on the Investigation of the Truth and Restoration of Honor for the Victims of the Jeju 4·3 Incident" was approved at the Cabinet meeting on the 7th.
In June 2021, a special provision for correcting family relationship registers through the decision of the 4·3 Committee was introduced to resolve discrepancies in family relationships related to the 4·3 Incident, but the scope of corrections to the family relationship register had been limited to the preparation of the victim's family relationship register and correction of the date of death.
Accordingly, the Ministry of the Interior and Safety, together with the Court Administration Office and Jeju Province, has been reviewing measures to expand the scope of corrections in the family relationship register to include "victims and bereaved families," and has also conducted related research projects (conducted by: Korea Institute of Criminology and Justice Policy). The Ministry of the Interior and Safety has established a legal basis for correcting family relationships through this amendment to the Enforcement Decree of the 4·3 Incident Act.
Through the amendment of the Enforcement Decree, actual children of the victims who had been registered in the family registers of relatives rather than the victim's own family register, thus living as nephews, siblings, etc., will be recognized as the legal children of the victims.
