The First Case of Prosecutorial Referral for a "Bad Dad" Who Didn't Pay Child Support for 13 Years
[Asia Economy Reporter Jang Hyowon] A man who failed to pay over 120 million won in child support to his ex-spouse for more than 10 years after their divorce has been referred to the prosecution. This is the first case of referral on charges of non-payment of child support.
The Siheung Police Station in Gyeonggi Province announced on the 28th that they had sent Mr. A, a man in his 50s, to the prosecution without detention on the 23rd on charges of violating the Act on the Guarantee and Support of Child Support (Child Support Enforcement Act).
Mr. A is accused of not paying over 120 million won in child support for two children to his ex-spouse, Ms. B, for 13 years after their divorce in 2010.
He was ordered to be detained last year for failing to comply with the court's child support enforcement order, and subsequently faced measures such as public disclosure of personal information, travel ban, and driver's license suspension for continued non-compliance.
Since the amendment of the Child Support Enforcement Act in July last year, the court can order detention in a police station holding cell or detention center for parents who do not comply with child support payment orders.
Despite the detention order and other measures, Mr. A did not properly pay child support, leading Ms. B to file a complaint against him at the Suseo Police Station in Seoul in October. The Siheung Police Station, which has jurisdiction over Mr. A's residence, took over the case and has been investigating.

A police official stated, "Based on the purpose of the Child Support Enforcement Act and after consultation with the Ministry of Gender Equality and Family, we decided to refer Mr. A to the prosecution."
