Possibility of 4th Injunction if New Interim Committee Launches Before Chuseok
[Asia Economy Reporter Yoo Byung-don] The hearing for the provisional injunction filed by former People Power Party (PPP) leader Lee Jun-seok and the objection filed by the PPP will be held simultaneously.
On the 2nd, the Civil Division 51 of the Seoul Southern District Court (Chief Presiding Judge Hwang Jeong-su) announced that it has scheduled the hearing for Lee’s provisional injunction request to prohibit the National Committee meeting (scheduled for the 5th of this month) to amend the party constitution for the 14th.
Since Lee submitted the request to prohibit the National Committee meeting as the principal application and the suspension of the effect of the National Committee’s resolution as an alternative application, considering the hearing schedule, the court is expected to review the related procedures and any defects after the National Committee’s constitutional amendment resolution on the 5th.
At the hearing, the court will also conduct hearings on Lee’s second provisional injunction request to suspend the duties of the Emergency Response Committee members and the PPP’s objection to the first provisional injunction.
If the PPP proceeds with launching the new Emergency Response Committee before the Chuseok holiday as planned, Lee is expected to file a fourth provisional injunction against the newly appointed Emergency Response Committee chairman and members, and the hearing for that may also be held together.
Lee’s legal team told reporters on the day, "If the new Emergency Response Committee chairman and members are appointed later, we plan to file an additional provisional injunction to suspend their duties."
Both sides are expected to engage in intense legal battles over whether the 'new Emergency Response Committee' promoted by the PPP after the suspension of Emergency Response Committee chairman Joo Ho-young’s duties is lawful and valid.

Lee’s side argues that the 'new Emergency Response Committee' contradicts the court’s judgment that the party is not in an emergency situation. On the other hand, the PPP side plans to counter that Lee was officially dismissed after the Emergency Response Committee was launched on August 16 and therefore does not currently hold the position of 'party leader,' so he lacks the standing to file a provisional injunction.
