Earlier, the Jeju District Prosecutors' Office appealed the special retrial decision made in March for Kim and the other 14 individuals, citing legal misunderstandings and procedural fairness. However, the Gwangju High Court dismissed the appeal, stating, "It is questionable whether it is necessary to re-examine the victim determination process for the 14 victims recognized by the 4·3 Committee." So far, 52 people have been acquitted in special retrials related to the 4·3 incident.
