[Asia Economy Reporter Hyunju Lee] On the 3rd, Kim Gi-hyun, a member of the People Power Party who was suspended from attending the National Assembly for 30 days for occupying the chair of the Legislation and Judiciary Committee during the process of passing the so-called 'complete removal of prosecution investigation rights (Geomsu Wanbak)' related bill, received an injunction suspending the effect of the disciplinary resolution by a unanimous decision of the Constitutional Court's full bench.
On the same day, Kim posted on his Facebook, calling it a "very natural decision" and saying, "It will be fascinating to see what sophistry the Democratic Party will come up with."
The Constitutional Court accepted Kim's injunction request to suspend the effect of the disciplinary action against the Speaker of the National Assembly with a unanimous opinion of all justices. Earlier, the Democratic Party submitted a disciplinary proposal against Kim on the 4th of last month based on Article 155 of the National Assembly Act, which allows disciplining a member of the National Assembly by a plenary session resolution without going through the Ethics Special Committee if the member occupies the chair of the Speaker or committee chairman. At the time of the disciplinary resolution, Kim wore a black tie and black suit and ascended the podium, lamenting, "The parliamentary democracy of this country is dead."
Kim criticized, "Assemblyman Lee Jae-myung, who said he would confine me to an Antarctic island because he hates me, Floor Leader Park Hong-geun who disgracefully stained the history of the National Assembly, and above all, former Speaker Park Byeong-seok who, by blindly following the Democratic Party's witch hunt, wrote a dark history that will remain in history. These people are the ones who should receive severe punishment," adding, "How dare the Democratic Party, which has sold democracy and only sought its own advancement, discipline anyone?"

The People Power Party held the Democratic Party responsible for the forced disciplinary action, calling it a just outcome. Park Hyung-soo, the floor spokesperson for the People Power Party, said, "This confirms once again that the disciplinary action against Assemblyman Kim was a violent act by the Democratic Party using its majority seats," and added, "The Democratic Party should apologize a hundredfold to the people." Yang Geum-hee, another floor spokesperson for the People Power Party, also condemned it as "a people's court-style violent act by the Democratic Party that failed to meet even the minimum legal requirements and procedures," and said, "We must now do our utmost to restore and protect the rule of law and democracy in South Korea, which had been tilted and collapsed."
