Lotte Shin Gyeok-ho's Nephew Finally Loses Sibling Lawsuit Over House Payment
[Asia Economy Reporter Kang Nahum] The nephew of the late Shin Kyuk-ho, Honorary Chairman of Lotte Group, has ultimately lost the appeal in a property inheritance dispute lawsuit against his siblings.
According to the legal community on the 16th, the Supreme Court's 3rd Division (Presiding Justice Kim Jae-hyung) recently upheld the lower court's ruling that dismissed the appeal filed by A (60), the daughter of the late Shin So-ha, brother of Honorary Chairman Shin, against her older brother B (70) and others, seeking recovery of inheritance.
A claimed that her uncle, Honorary Chairman Shin, had financially supported their mother to purchase a house, but after their mother's death, her older brother B, the registered owner, sold the house for 10 billion won and did not distribute the proceeds to her as a co-heir.
In response, A filed a lawsuit in 2019 against B demanding payment of 2 billion won, equivalent to one-fifth of the sale proceeds, but the first trial ruled against her, stating that aside from the family relationship and the house sale, there was no basis to recognize A's claims.
In the second trial, A changed the claim to jointly demand compensation of approximately 1.45 billion won from B and Shin Young-ja, director of the Lotte Welfare Foundation and sibling of Honorary Chairman Shin. However, this was also rejected.
Although she appealed the ruling, the Supreme Court found no grounds to review the case and upheld the second trial's decision as is.
