Yeongsangang Regional Environmental Office Conducts Capacity Building Training for Environmental Offense Enforcement Officers
[Asia Economy Honam Reporting Headquarters Reporter Park Jin-hyung] The Yeongsangang River Basin Environmental Office announced on the 31st that it conducted training to strengthen the enforcement capabilities of environmental crime enforcement officers in order to minimize cases of non-prosecution by the prosecution.
This training mainly analyzed the prosecution's disposition results after transferring environmental crime investigation results over the past year, as well as violation confirmation reports prepared by enforcement officers.
Last year, the Yeongsangang Office transferred a total of 95 environmental crime investigation cases to the jurisdictional prosecution office, but only 43 cases (45.3%) resulted in punishment, highlighting the need for enforcement officers to better understand relevant laws and improve skills in detecting violations on site.
The main content focused on how to prepare confirmation reports based on the five Ws and one H principle for environmental crimes, which serve as basic investigation data, and the scope of application of relevant laws.
Major cases of non-prosecution included minor violations lacking illegality or intent, expiration of the statute of limitations, insufficient objective evidence of violation, and non-application of grace periods stipulated by law.
Accordingly, enforcement officers were urged to prepare violation confirmation reports with accurate legal application and to conduct proactive inspections with a sense of responsibility to minimize non-prosecution dispositions.
