Court Rules "Consensual Relationship Under Coercion" Despite Defendant's Denial of Charges
[Asia Economy Honam Reporting Headquarters Reporter Park Jin-hyung] A boyfriend who took nude photos of his cohabiting girlfriend and forced sexual intercourse has been sentenced to prison.
The 12th Criminal Division of the Gwangju District Court (Presiding Judge No Jae-ho) sentenced Mr. A, who was detained and indicted on charges including quasi-rape, to five years in prison on the 16th.
He was also ordered to complete 80 hours of sexual violence treatment programs and was banned from employment at child and youth facilities and welfare facilities for the disabled for five years.
Mr. A was brought to trial on charges of assaulting his cohabiting girlfriend and committing quasi-sexual acts because she made him feel bad.
He took photos and videos of her kneeling while wearing only underwear or completely naked, and used force to have sexual intercourse against her will. It was revealed that this crime was committed during a recidivism period.
The victim suffered injuries requiring six weeks of medical treatment and is still reported to be suffering from physical and psychological trauma.
Mr. A admitted to the assault charges but denied the quasi-rape charges.
The court ruled, "Considering the evidence secured during the investigation and medical opinions, it can be recognized as guilty that sexual intercourse was forced under oppression," and added, "Looking at the photos and other recordings, it is clear how much pain the victim must have felt at that time."

However, the court explained the sentencing reasoning by stating, "Taking into account that there was no prior record of sexual crimes and that the victim did not desire very severe punishment."
