40s Woman Who Hit Daughter and Hit Male Elementary Student with Car Receives Suspended Sentence in Appeal Trial
[Asia Economy Yeongnam Reporting Headquarters Reporter Kim Yong-woo] A woman in her 40s who deliberately struck an elementary school student riding a bicycle with her car in a child protection zone near an elementary school in Gyeongju, Gyeongbuk, was given a suspended sentence in the appellate court.
The Daegu District Court 3-3 Criminal Division (Presiding Judge Seong Gyeong-hee) announced on the 22nd that in the appellate trial of Ms. A, a woman in her 40s charged with special injury and special intimidation, the original sentence was overturned and she was sentenced to one year in prison with a two-year suspension.
According to the Daegu District Court, Ms. A is accused of chasing and hitting a 10-year-old boy elementary student B, who was riding a bicycle in a school zone in Dongcheon-dong, Gyeongju, Gyeongbuk, with her SUV on May 25 last year.
CCTV secured by the police showed Ms. A getting out of the vehicle after hitting boy B and scolding him.
Boy B’s family claimed that the offending vehicle deliberately hit B. They also stated that the child had a fight with Ms. A’s daughter at the playground, and Ms. A “hit her daughter and did not apologize,” and “chased the child for 200 meters by car and caused the accident.”
Ms. A denied intentionality during the trial, saying, “I did not see boy B in my line of sight just before the collision.”
However, the first trial court judged that Ms. A had indirect intent regarding special intimidation, special injury, and special property damage, and sentenced her to one year in prison. However, considering the possibility of settlement and the fact that Ms. A has three children to care for, she was not detained in court.

The appellate court considered that defendant Ms. A deeply reflected on her actions, reached an amicable settlement with boy B’s parents, the crime did not appear to be committed with definite intent, and Ms. A’s children require the help of a guardian, and thus overturned the original prison sentence and sentenced her to a suspended sentence.
