Hospital Director in His 40s Receives Suspended Sentence for Alleged Sexual Harassment of Female Employee at Pharmaceutical Company
[Asia Economy Reporter Kim Daehyun] A male hospital director in his 40s who took a pharmaceutical company sales employee, who had collapsed drunk, to his home and sexually assaulted him was sentenced to a suspended prison term in the first trial.
According to the legal community on the 4th, the Seoul Central District Court Criminal Division 29 (Presiding Judge Kim Changhyung) sentenced A (49), who was indicted on charges including abduction and enticement for the purpose of sexual intercourse, to 1 year and 6 months in prison with a 2-year suspension. He was also ordered to complete 40 hours of a sexual violence treatment program and 80 hours of community service.
Earlier, A was brought to trial on charges of forcibly sexually assaulting B, a pharmaceutical company sales employee, who collapsed in a state of intoxication after having dinner together on September 29 last year, by taking him to his residence in Gangnam-gu, Seoul.
Article 288, Paragraph 1 of the current Criminal Act stipulates that "a person who abducts or entices another person for the purpose of molestation or sexual intercourse shall be punished by imprisonment for not less than one year and not more than ten years." Article 299 of the same law states that "if a person forcibly molests another by taking advantage of the person's mental incapacity or inability to resist, they shall be punished by imprisonment for not more than ten years or a fine not exceeding 15 million won."

The court stated, "Considering the relationship between the defendant and the victim, the circumstances and methods of the crime, the nature of the crime is not good," and added, "The victim experienced considerable mental shock and sexual discomfort."

However, the court added, "However, the defendant has admitted to the crime and shown a remorseful attitude in this court. It also appears that the crime was somewhat impulsive due to intoxication," and "Considering that a considerable amount was paid and a smooth settlement was reached, and the victim no longer wishes for punishment against the defendant, as well as the fact that there is no prior record of punishment for similar crimes."
