Teenage Woman Falsely Accusing "Sexual Assault" Found Not Guilty

The Changwon District Court Criminal Division 3-2 (Presiding Judge Yoon Seong-yeol) announced on the 23rd that it upheld the original not guilty verdict for A (19), who was tried on charges of false accusation and perjury.
A had consensual sex in July 2018 in a region of Gyeongnam with a peer who promised to quit smoking for 100 days together. Later, despite no such incident occurring, she filed a police report claiming she was sexually assaulted by B.
The court found that although there were suspicious parts in A’s accusation and testimony, it was difficult to conclude beyond reasonable doubt that the accusation was false or that the defendant made statements contrary to her memory.
Furthermore, even if some parts of the report contradicted objective facts, if it merely exaggerated the circumstances of the report, no crime was established.

The court stated, "Having some suspicious circumstances regarding the credibility of parts of the testimony alone cannot be deemed guilty," and "Even if some parts of the testimony are doubtful, it is difficult to conclude beyond reasonable doubt that the accusation was false or that the defendant made statements contrary to her memory."
