Prosecutor General Requests Changwon District Prosecutors' Office to Execute Sentence at Governor Kim Kyung-soo's Residence Jurisdiction
[Asia Economy Reporter Choi Seok-jin, Legal Affairs Specialist] On the 21st, the Supreme Prosecutors' Office requested the Changwon District Prosecutors' Office to carry out the execution of the sentence for Kim Kyung-soo, Governor of Gyeongnam Province, whose prison sentence was confirmed.
On the same day, the Supreme Prosecutors' Office stated, "We have requested the Changwon District Prosecutors' Office, which has jurisdiction over the residential area, to execute the confirmed sentence for Governor Kim."
However, it was reported that the execution request document sent by the Supreme Prosecutors' Office did not specify a separate place of execution.
The place of detention is decided by the jurisdictional prosecutors' office that receives the execution request, and it is usually set to a detention facility near the inmate's address. Unless there are special circumstances, Governor Kim is likely to be detained at Changwon Prison.
Since the court ruling takes effect immediately upon sentencing, the execution of the sentence can begin right away. However, based on precedents involving famous politicians in the past, it is expected that the prosecution will allow Governor Kim some time to arrange his personal affairs before proceeding with the execution.
The Supreme Court's 2nd Division (Presiding Justice Lee Dong-won) confirmed the original sentence of two years imprisonment for Kim Kyung-soo's computer-related obstruction of business charge in connection with the 'Druking comment manipulation' case on the morning of the same day. The charge of violating the Public Official Election Act was acquitted.
With the prison sentence confirmed on this day, Governor Kim lost his position as governor. According to the Public Official Election Act, when a sentence of imprisonment or higher is imposed, the right to run for office can only be restored after the sentence is extinguished.

According to the Act on the Execution and Exemption of Sentences, if a sentence of imprisonment of three years or less is imposed, the sentence is extinguished only after five years have passed since the completion or exemption of the sentence. Therefore, including the period of sentence execution, Governor Kim will be unable to run for public office for about seven years.
