Prosecutors' Office Investigates Prosecutor Who Ignored Statute of Limitations on Small Fraud in Case No. 6
[Asia Economy Reporter Kim Hyung-min] The High-ranking Officials' Crime Investigation Agency (Gong-su-cheo) has been confirmed to be investigating a public prosecutor who disregarded the statute of limitations on a minor fraud case, known as the 'Case No. 6.'
According to Yonhap News and legal circles on the 11th, Gong-su-cheo filed charges on the 1st of last month against Prosecutor Jang from the Haenam Branch of the Gwangju District Prosecutors' Office for dereliction of duty in the 'Gongje Case No. 6' this year and is currently investigating him.
Prosecutor Jang is accused of dismissing a minor fraud case transferred by the police with a prosecution opinion as 'no prosecution' after the statute of limitations had expired while working at the Jeonju District Prosecutors' Office in December last year.
Mr. A requested the investigative authorities to punish Mr. B on fraud charges in July last year for failing to repay a loan of 2 million won. After conducting a confrontation investigation between Mr. A and Mr. B, the Deokjin Police Station in Jeonju found grounds for suspicion against Mr. B and transferred the case to the Jeonju District Prosecutors' Office with a prosecution opinion in September of the same year.
The problem was that the statute of limitations for this case expired on December 3 of last year. Mr. A emphasized this in the complaint and requested a prompt investigation. However, Prosecutor Jang, the lead prosecutor, did not process the case for three months after the transfer, resulting in the expiration of the statute of limitations.
Furthermore, Prosecutor Jang summoned Mr. A on January 21, after the statute of limitations had already passed, to receive a supplementary victim statement. Mr. A reportedly was unaware at the time that Mr. B had been granted immunity due to the expiration of the statute of limitations.
Legal circles interpret this investigation by Gong-su-cheo as a strategic move targeting another instance of the prosecution protecting its own members.
The expiration of the statute of limitations is not uncommon during prosecution investigations. When cases pile up, minor cases like Mr. A's are sometimes overlooked by mistake. However, the prosecution has not disciplined prosecutors who have missed the statute of limitations until now. An analysis of prosecutor disciplinary records published by the Ministry of Justice over the past five years shows that no prosecutor has been disciplined for similar incidents.

Considering the pace of other investigations, if Gong-su-cheo quickly investigates Prosecutor Jang and brings him to trial, it could become the 'first indictment by Gong-su-cheo.'
