Prosecutors Seek Prison Sentence for Rottweiler Owner Who Killed Small Dog by Biting Without Muzzle
[Asia Economy Reporter Jeong Dong-hoon] The prosecution has requested a prison sentence for Mr. Lee (76), the owner of a dog who failed to muzzle his dangerous Rottweiler, resulting in the death of a small dog during a walk.
At the sentencing hearing held on the 28th at the Seoul Western District Court, Criminal Division 3, presided over by Judge Jeong Geum-young, the prosecution asked the court to sentence the defendant to six months in prison, stating, "The defendant is currently on probation and has a prior record of causing injury by negligence in a similar case."
The prosecution explained the reason for the request, saying, "Although the defendant claims there was no intent, the Rottweiler owned by the defendant has previously bitten or killed other small dogs on three occasions, so intent is sufficiently recognized," and added, "The victim has not forgiven the defendant."
Mr. Lee was prosecuted on charges of violating the Animal Protection Act and property damage for leaving his Rottweiler unmuzzled in a residential area of Bulgwang-dong, Eunpyeong-gu, Seoul, on July 25 last year, which led to the Rottweiler biting and killing a Spitz during a walk and injuring its owner. The victim dog owner sustained injuries requiring two weeks of medical treatment after being bitten by the Rottweiler.
The defense argued, "The previous incidents and this case are different situations," and claimed, "It is difficult to understand logically that the defendant managed the Rottweiler with indirect intent, leading to this incident."

They continued, "The defendant sincerely regrets and reflects on the harm caused," and requested leniency, asking the court to consider the defendant's disability diagnosis and mobility difficulties and to impose a fine instead of imprisonment.
