LG-SK, ITC Preliminary Decision on Patent Lawsuit Delayed by 2 Weeks
ITC Announces Preliminary Determination on Patent Infringement on April 2
ITC "Additional Time Needed"
[Asia Economy Reporter Hwang Yoon-joo] LG Energy Solution's preliminary decision in the battery patent infringement case filed against SK Innovation at the U.S. International Trade Commission (ITC) has been postponed.
The ITC announced on the 19th (local time) that the preliminary decision in the battery patent infringement lawsuit between LG Energy Solution and SK Innovation, originally scheduled for that day, has been postponed by two weeks to April 2. Accordingly, the final decision on this case has also been delayed by two weeks to August 2.
The ITC only stated that the reason for postponing the preliminary decision was "additional time is needed." Previously, ITC decisions related to trade secret infringement between the two companies were postponed three times due to COVID-19 and other reasons.
This patent infringement lawsuit began as part of the trade secret infringement lawsuit LG Energy Solution initially filed against SK Innovation.
In April 2019, LG Energy Solution filed a complaint with the ITC alleging that SK Innovation poached employees and infringed on trade secrets. In response, SK Innovation requested sanctions from the ITC in September of the same year, claiming that LG Energy Solution infringed on its battery patents.
However, LG Energy Solution filed a counter-lawsuit with the ITC, alleging that SK Innovation infringed on four of its U.S. patents, including three related to separators and one related to cathode materials.
