Supreme Court: Establishment of Puppet Unions Without Autonomy or Independence Is Invalid
[Asia Economy Reporter Baek Kyunghwan] The Supreme Court has ruled that a company-established company union, created with the intent to neutralize an existing labor union, is invalid from the outset.
On the 25th, the Supreme Court's 3rd Division (Presiding Justice Lee Dongwon) upheld the lower court's ruling in favor of the plaintiff in the final appeal of the case filed by the Korean Metal Workers' Union against Yuseong Enterprise and the company union, confirming the invalidity of the union's establishment.
In 2011, the Metal Workers' Union Yuseong Enterprise Branch experienced conflicts with management, including a workplace shutdown, during the process of introducing shift work. In response, the company established a second union in July 2011 with the purpose of neutralizing the existing union. The company pressured employees to join the new union and even encouraged managerial staff, who had not previously participated in union activities, to join. As a result, the new union became the majority union with over half of the employees as members.
In response, the Metal Workers' Union Yuseong Enterprise Branch filed a lawsuit against the company and the second union, claiming that the union established by the company was invalid.
The first trial court ruled that the second union created by the company could not be considered to have secured autonomy and independence, and thus its establishment was invalid. The appellate court also did not recognize the union established by the company. The company appealed, arguing that although the company union lacked autonomy and independence at the time of establishment, it met the requirements afterward. However, the court ruled that the union violated the Labor Union Act, which explicitly requires autonomy and collectivity as substantive conditions for a union.
On this day, the Supreme Court maintained the same position. The court stated, "If an employer establishes a union to control or interfere with union activities, even if the establishment report is accepted, the union does not have the status of a subject with labor rights."

A Supreme Court official explained, "This is the first ruling recognizing that if a union does not meet substantive requirements such as subjectivity and autonomy at the time of establishment, a lawsuit to confirm the invalidity of the establishment can be filed."
