LG Energy Solution "Final Victory in ITC Trade Secret Infringement Lawsuit"
[Asia Economy Reporter Hwang Yoon-joo] LG Energy Solution announced that "the U.S. International Trade Commission (ITC) has ruled in favor of LG Energy Solution in the final determination of the trade secret infringement lawsuit against SK Innovation regarding secondary batteries."
On the 10th, LG Energy Solution stated, "The ITC ordered a '10-year import ban in the U.S.' on SK Innovation's battery cells, modules, packs, and related parts and materials that infringed LG Energy Solution's trade secrets, violating Section 337 of the U.S. Tariff Act."
However, the ITC has allowed limited imports of battery parts and materials for Ford's electric pickup truck F150 for 4 years, and for Volkswagen's MEB battery parts and materials for 2 years. Additionally, imports of battery products for repair and replacement of batteries used in Kia electric vehicles already on sale are permitted. For the infringing items allowed limited import, compensation can be sought later through damages in the Delaware Federal District Court lawsuit.

LG Energy Solution explained, "The ITC also issued a '10-year injunction to stop trade secret infringement,' prohibiting the production, distribution, and sale of the infringing items already imported within the U.S." They added, "This ITC decision acknowledges LG Energy Solution's claim that SK Innovation unlawfully used LG Energy Solution's secondary battery-related trade secrets in a wide range of areas including research and development, production, testing, orders, and marketing, causing economic damage."
