Suncheon City Implements 'Special Measures Act' to Correct Real Estate Ownership Rights
[Asia Economy Honam Reporting Headquarters Reporter Lee Hyung-kwon] Suncheon City (Mayor Heo Seok) announced on the 4th that it is implementing a special measure law that allows simplified registration of real estate whose registry does not match the actual rights relationship.
The "Special Measures Act on Real Estate Ownership Transfer Registration, etc." is a law that allows real estate that was effectively transferred by legal acts such as sale, gift, or exchange before June 30, 1995, inherited real estate, and real estate without ownership preservation registration to be registered through a simplified procedure. It has been temporarily enforced for two years since August 5 last year.
To transfer ownership under the special measure law, one must obtain confirmation from five or more guarantors (including one lawyer or judicial scrivener) appointed by the town or township head and the mayor, submit an application for the issuance of a confirmation letter to the Suncheon City Land Information Division, and pay a fee to the qualified guarantors.
The city issues the confirmation letter after verifying the purpose of the guarantee, conducting on-site investigations, notifying interested parties within four degrees of kinship such as heirs, and going through a two-month public notice period without any objections. Thereafter, the applicant can apply for registration at the court by attaching the confirmation letter.
Suncheon City has appointed a total of 985 guarantors, including 966 village guarantors and 19 qualified guarantors, and operates a Real Estate Special Measures TF team for smooth work progress. So far, 802 land cases and 30 building cases have been received; 86 land cases have received confirmation letters and completed registration transfer, and the confirmation issuance process is ongoing for the remaining real estate.
