Court Dismisses Injunction Prohibiting Agreement on Guri Hangang Riverside Development Project
[Asia Economy Reporter Ra Young-cheol] The court ruled in favor of Guri City in the injunction lawsuit related to the selection of the developer for the 'Guri Hangang Riverside Development Project.'
Guri City announced on the 10th that "the 30th Civil Division of the Uijeongbu District Court dismissed the injunction request to prohibit the conclusion of a business agreement with the preferred negotiation partner for the Guri Hangang Riverside Urban Development Project."
According to the court's decision disclosed by the city, "The bidding guidelines are merely internal regulations of the debtor (Guri Urban Corporation), so it is difficult to consider the debtor bound by them, and it is reasonable to regard 'S Construction' as ranked 10th in construction capability evaluation based on the 2020 public announcement."
It added, "Basically, the construction capability evaluation and the announcement timing are based on 'the most recent data as of the bidding date,' meaning the closest construction capability evaluation and announcement data as of the bidding date, August 3, 2020, and there is no reasonable reason for the debtor to base it on the 2019 announcement data."
The court also stated, "It is hard to believe that the creditor, a major domestic construction company, was unaware of the reference point, and if there were ambiguous parts, the debtor had opportunities to inquire again but did not do so."
Earlier, the representative of Consortium A, who filed the injunction request, filed a lawsuit last November claiming that "since the construction capability evaluation ranking of S Construction, a member of the consortium, was 11th based on 2019, Guri Urban Corporation's revocation of the preferred negotiation partner status and awarding it to the runner-up consortium was wrong," requesting recognition of the preferred negotiation partner status and suspension of the business agreement with the runner-up consortium.
Mayor Ahn Seung-nam commented on the ruling, saying, "With the court's dismissal of the injunction request related to the GWDC termination, the Hangang Riverside Urban Development Project is expected to gain more momentum," and expressed sincere gratitude to the court for its wise judgment.

The Guri Hangang Riverside Urban Development Project involves developing approximately 1,498,000㎡ of land in the restricted development zones of Topyeong-dong and Sutaek-dong to build industrial facilities and housing. The total project cost is in the 3 trillion won range.
