Man Charged with 'Special Injury' Against Partner, Woman Not Prosecuted for 'Assault'

The police investigating the Busan Deokcheon Underground Shopping Center dating violence incident (reported in the November 10 online edition) decided to apply the charge of aggravated injury against a man who hit his girlfriend with a cellphone.
According to the Busan Northern Police Station on the 25th, the cellphone used to hit the woman was considered a weapon, and the aggravated injury charge was applied. The man, Mr. A (in his 20s), was sent to the prosecution with a recommendation for indictment without detention.
Mr. A is accused of hitting his girlfriend, Ms. B (in her 30s), who had collapsed at the Busan Deokcheon Underground Shopping Center on the 7th, with a cellphone, causing injuries.
During the police investigation, both parties, who are in a romantic relationship, stated that they did not wish to press charges against each other.
After confirming the scene in the video where Mr. A hits the collapsed Ms. B with a cellphone, the police visited the hospital where Ms. B received treatment and verified the diagnosis of her injuries, leading to the application of the aggravated injury charge.
The aggravated injury charge is established when a group or multiple people use force, or when a dangerous object is carried and used to assault a person’s body causing injury.
Assault charges are ‘offenses not punishable without the victim’s complaint,’ meaning if the victim does not wish to press charges, prosecution is not possible. However, aggravated injury charges can be prosecuted even if the victim agrees to a settlement.
Under criminal law, aggravated injury carries a prison sentence of one year or more and up to ten years without a fine.
The police applied only assault charges to the female party, Ms. B, and forwarded the case to the prosecution with a recommendation of ‘no prosecution’.
