Gwangju City Strengthens Management of Apartment Complexes with Fewer Than 150 Households
Enforcement of the Amendment to the Enforcement Decree and Enforcement Rules of the Apartment Housing Management Act
[Asia Economy Honam Reporting Headquarters Reporter Park Seon-gang] Gwangju Metropolitan City announced on the 21st that starting from the 24th, with the enforcement of the revised "Enforcement Decree and Enforcement Rules of the Apartment Management Act," small to medium-sized apartment complexes with fewer than 150 households will also be converted to and managed as mandatory management apartment complexes with the consent of residents and others.
According to the revision, if two-thirds or more of the residents and users living in the relevant apartment complex agree, it will be possible to convert it into a mandatory management apartment complex.
Until now, mandatory management applied only to complexes with 300 or more households, those with 150 or more households equipped with elevators or central heating (including district heating), or mixed-use residential buildings with 150 or more households.
Additionally, users who are not residents can now be elected as representatives of each building, preventing cases where residents' representative meetings are not formed due to residents' indifference or an increase in tenant households, which infringes on the rights and interests of residents and others.
In mixed housing complexes where both sale and rental housing coexist, the decision-making method for joint matters will be unified, allowing the residents' representative meeting or rental business operator managing more than half of the supply area to make decisions quickly.
Furthermore, by supplementing the disqualification criteria for building representatives and election management committee members, if a building representative is automatically dismissed due to continuous arrears of management fees for more than three months, they will be prohibited from running in by-elections for one year.
If a building representative is automatically dismissed due to disqualification or other reasons, they will not be allowed to serve as an election management committee member for the remaining term, strengthening the fairness of election management.
The manager of the management office must receive apartment management and ethics education within three months from the date of appointment, advancing the timing of education to ensure there is no disruption in the role performance of apartment managers.
In addition, small to medium-sized apartment complexes with 100 or more households will be required to disclose management fees and other information, and external audits, contracts, and local government audit results will be posted on each building's bulletin board to enhance transparency in apartment management. It will also become easier to convert to separated household-type apartments, greatly improving convenience for the public.
