Ministry of Justice Extends Stay Period for Foreign Workers Whose Employment Activity Period Has Expired
[Asia Economy Reporter Song Seung-yoon] The Ministry of Justice announced on the 21st that it will extend the stay period for foreign workers whose domestic stay period has expired. This measure aims to address the labor shortage in industrial sites caused by the novel coronavirus infection (COVID-19).
The Ministry of Justice, anticipating labor shortages in some industrial sites due to delays in introducing new foreign workers, has decided in consultation with the Ministry of Employment and Labor and the Ministry of Oceans and Fisheries to extend the stay period of foreign workers such as seafarers by up to 50 days.
The extension targets foreign workers holding non-professional employment (E-9) and seafarer employment (E-10) visas whose employment activity period (4 years and 10 months) has expired. This includes foreign workers classified as "diligent workers" who are scheduled to re-enter the country with their employment permits issued, and foreign seafarers who wish to continue working until new seafarers are smoothly introduced. A diligent worker refers to a worker who completes domestic employment activities for 4 years and 10 months, returns to their home country, and then re-enters the country for re-employment after 3 months.
For those holding non-professional employment visas, the Ministry of Employment and Labor selects the eligible individuals, while for those holding seafarer employment visas, the Ministry of Oceans and Fisheries selects them and notifies the Ministry of Justice. Eligible individuals can extend their stay period by up to 50 days without visiting local immigration offices.
