Employment Screening for LH Employees Expanded from Grade 2 and Above to Grade 3 and Above
Starting next year, employment screening standards for retired public officials in the architecture and construction sectors will be significantly strengthened. In addition, the employment screening requirement for employees of Korea Land and Housing Corporation (LH) will be expanded from the current Grade 2 and above to Grade 3 and above.
On December 9, the Ministry of Personnel Management announced that the revised Enforcement Decree of the Public Service Ethics Act, which includes these changes, was approved at a Cabinet meeting. Employment screening target institutions are those where, for three years after retirement, eligible individuals must undergo a review by the relevant Public Service Ethics Committee before they can be employed.
Under the revised regulations, which will take effect in January next year, construction engineering businesses and architectural offices engaged in design or supervision work in the architecture and construction sectors will be designated as employment screening target institutions if their annual gross transaction amount is 1 billion won or more, regardless of their capital size.
Previously, only private companies with a capital of at least 1 billion won and annual gross transactions of at least 100 billion won, or companies with a capital of at least 100 million won and annual gross transactions of at least 1 trillion won, were designated as employment screening target institutions. As a result, the number of institutions in the architecture and construction sectors, which have a direct impact on public safety, subject to employment screening is expected to increase significantly.
Additionally, the employment screening requirement for Korea Land and Housing Corporation employees will be expanded from Grade 2 and above to Grade 3 and above for three years after retirement. The criteria for employment screening based on the institution's work, rather than the department to which the employee belonged, will also be strengthened from the current Grade 1 and above to Grade 2 and above. These measures aim to eliminate the practice of preferential treatment for retired officials, and those retiring from the effective date onward will be subject to the revised employment screening standards.
