Achimhae Medical Devices Files Lawsuit to Cancel Patent Decision
On October 28, Achimhae Medical Devices announced that it has filed a lawsuit with the Patent Court to cancel a decision made by the Intellectual Property Trial and Appeal Board regarding a patent invalidation trial and a scope confirmation trial related to its own patents.
A representative from Achimhae Medical Devices stated, "We believe there are significant legal issues in the interpretation of the decision," adding, "We plan to actively contest the decision through the cancellation lawsuit."
Achimhae Medical Devices further claimed that, during the litigation process, it confirmed that the product from Rebusmed could potentially infringe on additional claims of the registered patent beyond those originally asserted. The company submitted a written statement to the court to add these claims to the ongoing patent infringement lawsuit.
The company expects that the infringement lawsuit will proceed with an expanded scope compared to the previous decision. It anticipates that a substantive judgment on infringement will be delivered through the civil trial, which has not yet reached a verdict on the merits.
A representative from Achimhae Medical Devices commented, "This decision is merely a temporary outcome in the ongoing patent dispute and does not signify the end of the entire dispute. We do not believe the infringement has been resolved and will continue to pursue the protection of our legitimate rights through the remaining trials and civil proceedings."
