International Dispute Over Classification of 'Radio Units' Exported to India Resolved
0% Tariff If Classified as Parts Instead of Communication Equipment
Regarding the case in which the Indian government imposed tariffs by classifying radio units (RUs) for base stations exported to India by overseas affiliates of Korean companies under a different category, the World Customs Organization (WCO) has ultimately adopted the position of the Korean companies.
The Ministry of Economy and Finance, the Korea Customs Service, and the Ministry of Foreign Affairs announced on the evening of September 18, Korea time, that the WCO had reached this decision. Since the Indian government’s taxation stance was confirmed in 2023, the RU case was submitted to the WCO’s Harmonized System Committee, and after three rounds of discussions and voting, the Korean side’s position was finally confirmed on this day.
The RU is a core device that constitutes a base station in a mobile communication network. It is located between the digital unit (DU) and the antenna. It converts the digital signals received from the DU into analog (RF) signals according to frequency bands, amplifies them, and transmits them to the antenna. It also converts the RF signals received from the antenna into digital signals and delivers them to the DU.
The Indian government had classified imported RUs as communication equipment (HS 8517.62) and imposed a 20% tariff. The Korean side has maintained that they should be classified as parts (HS 8517.79), which are subject to a 0% tariff. The disputed amount related to the tariffs imposed by the Indian government due to its different classification of the items has reached approximately 800 billion won.
The government stated, "Although this WCO decision does not have binding force on individual member countries, it is significant in that the international community has agreed to interpret RU items in line with the Korean position." The government added, "It is expected to work favorably for our companies in future tax negotiations with the Indian tax authorities."
