Special Prosecutor on Insurrection Files Additional Charges and Requests Detention
The court has dismissed the objection filed by former Defense Minister Kim Yonghyun against the additional indictment brought by Special Prosecutor Cho Eunsuk, who is investigating the insurrection case.
On June 25, the 20th Criminal Division of the Seoul High Court (Chief Judge Hong Donggi) dismissed Kim's objection. A dismissal means the case is closed without a substantive judgment when the requirements are not met.
Previously, on June 18, Special Prosecutor Cho Eunsuk filed additional charges against Kim Yonghyun for obstruction of official duties by fraudulent means and for instigating the destruction of evidence. The special prosecutor also requested the cancellation of Kim's bail and the issuance of an additional arrest warrant.
With his release approaching, Kim Yonghyun immediately objected to the legitimacy of the additional indictment. He filed both an objection and a request for a stay of execution, seeking to halt the indictment procedures. According to the Special Prosecutor Act on Insurrection, the person under investigation or their attorney may file an objection with the Seoul High Court if the special prosecutor summons or investigates someone unrelated to the case, or otherwise exceeds their official authority.

On June 21, the High Court also dismissed Kim Yonghyun's request for a stay of execution, stating that the matter should be decided by the Seoul Central District Court, which is in charge of the case.
