Namyangju City Initiates Legal Review of Alleged Housing Act Violations
Namyangju City: "Doing Our Best to Prevent Harm Through Proactive Administration"
On May 21, Namyangju City in Gyeonggi Province announced that it is currently conducting a legal review regarding complaints about the 'Changhyeon Regional Housing Cooperative' in Hwado-eup, as well as allegations raised by some media outlets concerning potential violations of the Housing Act.
Namyangju City stated that, in response to complaints that the cooperative failed to entrust the management of its funds to a trust company as required by Article 11-2, Paragraph 3 of the Housing Act, it will promptly take administrative actions such as imposing fines if any legal violations are confirmed.
The city also explained that a regional housing cooperative is an unincorporated association voluntarily formed by multiple citizens, where decisions are made by majority vote through general meetings and representatives. As a result, it is structurally difficult for administrative agencies to directly intervene in matters related to private assets, such as internal fund management or land auctions.
Additionally, regarding claims that "the Changhyeon Regional Housing Cooperative violated Article 11-6, Paragraph 1 of the Housing Act, which requires cooperative membership fees to be deposited with a trust company," Namyangju City clarified, "The Changhyeon Regional Housing Cooperative completed its membership recruitment notification before the relevant regulation came into effect, so the revised trust deposit rule does not apply."
Meanwhile, since the launch of the 8th popularly elected administration, the city has produced promotional materials titled 'Important Points to Check When Joining a Regional Housing Cooperative' to prevent harm to citizens. These materials have been distributed to the city hall civil service office, administrative welfare centers in towns and villages, and areas with a high concentration of apartment complexes. Furthermore, Namyangju City has conducted supervision and management of a total of 13 regional housing cooperative operators currently active in the city, including one administrative order, six criminal complaints, and 15 instances of administrative guidance. The city plans to continue taking proactive measures and providing guidance to prevent any harm to well-intentioned citizens.
