The government has stated its position to follow the law regarding the recommendation of candidates for the permanent special prosecutor.
A senior official from the Prime Minister's Office said on the 20th at the Government Seoul Office Building, in response to a question about the "timing of the recommendation of candidates for the permanent special prosecutor," "We will act according to the Constitution and the law," adding, "We are listening to various opinions and thoroughly reviewing the matter." The proposal for a permanent special prosecutor investigation into the emergency martial law situation was passed in the National Assembly plenary session on the 10th, led by the opposition party. The Democratic Party of Korea insists that candidates for the special prosecutor must be recommended immediately according to the Special Prosecutor Act.

The Special Investigation Unit of the National Police Agency's National Investigation Headquarters investigated nine attendees of the Cabinet meeting convened by President Yoon Seok-yeol just before the emergency martial law was declared, including Acting Prime Minister Han Deok-su, either as suspects or witnesses until this day. The investigation was conducted in a non-public, face-to-face format, and President Yoon has not responded to summons requests. A Prime Minister's Office official said, "The investigation took place before the transition to the acting authority system," but refrained from providing specific details about the timing and location of the investigation. The acting authority system began on the evening of the 14th, when the impeachment motion was passed.
