Samsung Display Files Complaint with US ITC Over Trade Secret Infringement by Chinese BOE
Samsung Display has filed a complaint with the U.S. International Trade Commission (ITC) against its competitor, Chinese company BOE, alleging trade secret infringement.
On the 31st of last month (local time), Samsung Display filed a lawsuit with the ITC against BOE and eight affiliated companies, including BOE's subsidiaries, for trade secret infringement.
In the complaint, Samsung Display claimed that BOE infringed on trade secrets related to organic light-emitting diode (OLED) panel and module technology through its partner company, Toptec, starting from the end of 2017.
Earlier in March, the Suwon High Court found Toptec employees guilty of selling Samsung Display's edge panel technology, which implements curved screen edges on mobile phones, to China.
During the trial, Samsung Display reportedly detected evidence that Chinese companies, including BOE, were involved in the technology leak, prompting the current lawsuit.
Separately, the two companies are also engaged in patent infringement litigation. In June, Samsung Display filed a patent infringement lawsuit in the U.S. District Court for the Eastern District of Texas, claiming that BOE infringed its patents by selling panels similar to those used in the iPhone 12 in the U.S. market.

In December of last year, Samsung Display filed a complaint with the ITC against U.S. parts wholesalers to prevent the use of components and panels that infringe its patents. In May, BOE filed a countersuit in the Chongqing No. 1 Intermediate People's Court against Samsung Display's China subsidiary and Samsung Electronics' China subsidiary, alleging patent infringement.
