Same 1 Year 6 Months Prison Sentence in Second Trial
Court: "Serious Nature of Crime... High Potential for Social Condemnation"
A man in his 40s was sentenced to prison for throwing objects at his elderly mother in her 70s and grabbing her hair to strike her with furniture, simply because her behavior annoyed him.
According to Yonhap News on the 8th, the Chuncheon District Court Criminal Division 2 (Chief Judge Lee Young-jin) sentenced Mr. A (40), who was charged with special injury to a senior, special assault on a senior, and violation of the Elderly Welfare Act, to 1 year and 6 months in prison and ordered a 3-year employment ban at elderly-related institutions. Mr. A received the same 1 year and 6 months prison sentence in the first trial as well as the second trial.
Mr. A was brought to trial on charges of throwing a hand mirror and remote control at his mother, Ms. B (70), in the early morning last July, then grabbing her hair and dragging her to strike her head with a dining chair, causing injury. He assaulted her because he was annoyed that Ms. B approached him while he was trying to sleep and was removing used tissue from her nose.
In 2021, Mr. A also assaulted Ms. B three times by twisting her arm and hitting her with a cellphone or remote control, and in 2017, he threw a dining table and a fan, injuring Ms. B. It was reported that these crimes were also committed simply because he was annoyed by the victim’s behavior.

Ms. B did not want her son Mr. A to be punished, but the first trial court stated, "Mr. A’s criminal nature is bad," and "Considering the high possibility of social condemnation, a prison sentence is imposed." The second trial court also explained the sentencing by saying, "No significant change in circumstances has been found since the original verdict." Appeals by the prosecution and Mr. A claiming the sentence was too light or too heavy were all dismissed.
