“Customer Got On!” Employee Testing Positive for Philopon at Restroom Found Not Guilty
An entertainment establishment employee who tested positive for methamphetamine in a urine test was acquitted. The employee consistently claimed that "a customer secretly slipped it into the drink," and the court accepted this claim.
The Busan District Court Criminal Division 12 (Judge Jeong Cheol-hee) announced on the 23rd that it had acquitted Mr. A, who was tried on charges of violating the Narcotics Control Act.
Mr. A was accused of using methamphetamine between November 2 and 11, 2020.
According to the Busan District Court, although a positive reaction for methamphetamine was found in Mr. A's urine sample collected at the Busan Probation Office in November 2020, the prosecution's facts were not proven.
Mr. A, who worked as an entertainment establishment employee, consistently claimed, "A customer secretly slipped methamphetamine into the drink and handed it to me, so methamphetamine may have been detected in the urine test," and stated, "I did not use methamphetamine myself."

The court stated the reason for the acquittal: "The date, place, method, and circumstances of methamphetamine use were not specified, and there is no evidence that methamphetamine was found on or around Mr. A's body or that there were traces of direct methamphetamine use."
