50-Year-Old Sentenced to Prison for Habitual Abuse of 3-Year-Old Autistic Son

Court: "Guilty of Charges, but Spouse Wishes to Maintain Family"
[Asia Economy Reporter Hwang Sumi] A man in his 50s accused of repeatedly abusing his 3-year-old son with autism symptoms was sentenced to a suspended prison term and released. Although the abuse by the head of a multicultural family was acknowledged, the court judged that correcting violent tendencies through treatment should take precedence over punishment.
According to Yonhap News on the 11th, the Chuncheon District Court Wonju Branch Criminal Division 2 (Judge Lee Jisoo) sentenced Mr. A (53), who was detained and prosecuted on charges of violating the Child Welfare Act (habitual child abuse), to two years in prison with a four-year suspension. Additionally, he was ordered to undergo probation for three years, be restricted from employment in child-related institutions for three years, complete 320 hours of community service, and attend 40 hours of child abuse treatment lectures.
Mr. A was brought to trial on charges of injuring his son B (3) at their home around 2:20 p.m. on April 15. When his son cried intensely, Mr. A grabbed the back of his son's head and pushed him to the floor, causing his forehead to hit the ground. He also grabbed his son's collar, lifted him up, dragged him, and threw him onto the sofa.
There were multiple previous incidents of abuse by Mr. A. On November 29 of last year, he hit his son's face inside his car while moving from daycare to home, and on October 31 at around 4:30 p.m., he struck his son's face and buttocks five times with a back scratcher at their home, causing injuries.
In court, Mr. A explained, "I did hit him with a back scratcher, but it was for disciplinary purposes." He also denied the charges, stating, "I did not hit his face or cause his forehead to hit the floor." His wife, an immigrant by marriage, reportedly supported Mr. A during the investigation and trial process.
The court stated, "The abuse video voluntarily submitted to the investigative agency is admissible as evidence, and considering the legally obtained evidence and testimonies, all charges are proven guilty." The court also viewed the defendant's child abuse as a manifestation of a habitual behavior deeply ingrained over a long period.

However, the court explained the sentencing rationale, saying, "Considering that the spouse wishes to maintain the family by improving the violent tendencies through education and treatment rather than criminal punishment, and that the defendant himself recognizes the seriousness and the need for treatment, the sentence was determined accordingly."
