Viewing of National Pension Rights Remedy Cases Available... "Enhancing National Interests"
[Asia Economy Reporter Byeon Seon-jin] From now on, major cases of review and reexamination requests related to objections to the National Pension will be available for viewing on the Ministry of Health and Welfare and National Pension Service websites. It is expected to reduce social costs by allowing beneficiaries to check existing cases before filing lawsuits or missing out on receiving the National Pension due to lack of information.
The Ministry of Health and Welfare and the National Pension Service announced on the 20th that they have published the "2022 National Pension Rights Remedy Casebook," which contains cases of rights remedies for National Pension subscribers and beneficiaries, and will provide it as an e-book on their websites starting from the 21st.
The procedure for objections to the National Pension system regarding subscriber qualifications or pension benefits decisions by the Service is objection → review request → reexamination request → lawsuit.
The majority of cases protect rights through the objection process at the National Pension Service branch offices. However, since it is necessary to specifically review the legal application standards depending on individual cases, separate procedures have been established to protect citizens' rights by allowing review requests to the National Pension Service or reexamination requests to the Ministry of Health and Welfare.
To help citizens prevent disadvantages related to the National Pension in advance, over 200 major cases of review and reexamination requests have been organized by type.
The rights remedy casebook includes not only accepted cases where the claimant’s arguments were upheld but also many rejected cases where the claimant’s arguments were unfortunately not accepted, to prevent situations where beneficiaries fail to prepare in advance before rights arise or where existing rights are extinguished due to lack of knowledge about the National Pension system.
