The People Power Party stated on the same day, "We have sent an official letter to the Chief Judge of the Seoul Southern District Court requesting the reassignment of the case related to the 4th and 5th provisional injunction cases."
The party cited the reason for the request as follows: "The current presiding judge (the 51st Civil Division) went beyond the 'procedural illegality judgment' and departed from established legal principles and precedents to judge political matters such as the 'applicability of an emergency situation and the necessity of establishing an Emergency Response Committee.' It is difficult to properly guarantee trust in fairness if the trial proceeds again under such a presiding judge who made this decision."
Former leader Lee filed provisional injunctions at the Seoul Southern District Court to suspend the duties of Emergency Response Committee Chairman Jeong Jin-seok (4th case) and six nominated emergency committee members (Kim Byung-min, Kim Sang-hoon, Kim Jong-hyuk, Kim Haeng, Jeon Ju-hye, Jeong Jeom-sik) (5th case), respectively.
The People Power Party also stated, "According to the judge assignment system of the Seoul Southern District Court, there is the 52nd Civil Division in addition to the 51st Civil Division for the application panel, but assigning only the 51st Civil Division to the provisional injunction cases filed by former leader Lee Jun-seok is sufficient to raise doubts about fairness." They further argued the need for reassignment, saying, "One of the debtors in the 5th provisional injunction case, Emergency Response Committee member Jeon Ju-hye, is a classmate of the presiding judge of the 51st Civil Division at Seoul National University Law School."

Regarding the demand for replacement because the former emergency committee member is a classmate of the current presiding judge at Seoul National University, he criticized, "This is nonsense from the start, but does it make sense to file a recusal request just because it might be advantageous to them? Among legal professionals in Korea, how many are Seoul National University graduates? If this is accepted, how many absurd and awkward incidents will occur in Korean courts in the future?" He added, "When people who are not fools act irrationally, I will generally interpret it as a 'delay tactic.' I don't know if it's a coincidence, but replacing the emergency committee member from Joo Ki-hwan to Jeon Ju-hye at the last minute might have been for this purpose."
