"Threatened to kidnap family" 40s man threatens Rep. Yoon Young-chan... 2nd trial also 10 months imprisonment
Law: "Damage has not been restored and the nature of the crime is not minor"
[Asia Economy Reporter Oh Gyumin] A man in his 40s who sent a threatening email to Yoon Young-chan, a close aide of former Democratic Party leader Lee Nak-yeon, was sentenced to prison again in the appellate court.
On the 28th, the Criminal Appeals Division 1-3 of the Seoul Western District Court (Presiding Judges Ahn Jong-hwa, Kim Do-gyun, Choi Eun-joo) dismissed the prosecution's appeal against Park (47), who was indicted on charges of threats, and upheld the original sentence of 10 months in prison.
The court pointed out, "The damages to multiple victims have not been restored, forgiveness has not been granted, and the nature of the crime is not minor."
However, the court explained the sentencing reasons, stating, "The defendant fully admitted to the crime and deeply repents, and there are no other special criminal records, as well as mitigating circumstances such as bipolar disorder."
Earlier, the first trial court sentenced Park to 10 months in prison, stating, "Based on the evidence submitted by the prosecution, all the charges are recognized as guilty," and "Park showed no remorse, consistently making unconvincing excuses during the trial."
In response, the prosecution filed an appeal, arguing that the sentence was too light, and at the sentencing hearing held on the 3rd, requested a prison term of 2 years and 6 months, stating, "Considering the charges in this case, various crimes including threatening a presidential candidate were committed."
Park's side reportedly showed remorse on the day, saying, "We acknowledge all the crimes committed and sincerely apologize."
