Yang Kyung-sook, accused of nomination fraud, acquitted of 'apartment contract forgery' charges
1st Trial: 1 Year 8 Months Imprisonment → 2nd Trial "Guilt Not Proven" Acquittal
[Asia Economy Reporter Heo Kyung-jun] Yang Kyung-sook (61), head of the internet radio broadcasting programming department, who was sentenced to prison for the Democratic United Party nomination fraud case, was acquitted after being tried for forging apartment contracts and other documents.
The Supreme Court's First Division (Presiding Justice Kim Seon-su) announced on the 13th that it upheld the appellate court's acquittal ruling in Yang's appeal trial on charges of forgery of private documents and use of forged private documents.
Yang was prosecuted on charges of forging three contract confirmation letters to make it appear as if she had purchased an apartment for 700 million won from an acquaintance, A, around 2012, despite not actually buying the apartment. She was also charged with forging two loan agreements stating that A had borrowed 650 million won from her.
The first trial court sentenced her to 1 year and 8 months in prison, stating, "The defendant's statements regarding the circumstances of the document preparation are neither consistent nor specific, lack rationality, and seem to be aimed at evading prosecution for the criminal facts."
However, the appellate court's judgment differed. The second trial court ruled not guilty, stating, "It is difficult to conclude beyond reasonable doubt that the contract confirmation letters and loan agreements were forged."
