Court Sentences 60s to Imprisonment for Violating Restraining Order with Verbal Abuse and Assault
Court: "Violated Victim Protection Order Multiple Times Despite Receiving It"
[Asia Economy Reporter Oh Gyumin] A man in his 60s who violated a court-issued restraining order by visiting his family’s home, verbally abusing, and assaulting them was sentenced to imprisonment in the first trial.
On the 15th, Judge Ji Sangmok of the Criminal Division 7 at the Seoul Western District Court announced that Shim (67), who was indicted on charges including assault and violation of the Special Act on the Punishment of Domestic Violence Crimes, was sentenced to six months in prison and ordered to complete 40 hours of a domestic violence treatment program.
Judge Ji stated, “Not only did the defendant repeatedly violate the victim protection order, but he also verbally abused and assaulted the victim, who is his older sister, showing a serious nature of the crime,” adding, “The victim has suffered considerable shock, and recovery has not been achieved.”
However, Judge Ji explained the sentencing by considering “the defendant had lived at the location of the incident for a long time and his financial situation is difficult to live elsewhere.”
Shim was indicted for entering his older sister’s home around September last year, arguing about the fact that he was reported by the victim, and attempting to strangle her while saying, “I will split your head with my cellphone.”

Additionally, from August to October last year, Shim is also accused of violating the order prohibiting him from approaching the victim and her residence by visiting her home, verbally abusing her, and causing disturbances.
