Court: "Samsung Electronics Service Repair Technicians Are Workers"
[Asia Economy Reporter Kim Hyung-min] Repair technicians from Samsung Electronics Service's partner companies have won a lawsuit confirming their worker status against Samsung Electronics Service after 9 years.
The Civil Division 1 of the Seoul High Court (Presiding Judges Jeon Ji-won, Lee Ye-seul, Lee Jae-chan) ruled on the 26th in favor of the plaintiffs in part in the lawsuit filed by four individuals including Mr. A against Samsung Electronics Service.
The court overturned the first-instance ruling that had dismissed the plaintiffs' claims. It recognized that "there was a worker dispatch relationship between the plaintiffs and Samsung Electronics Service," siding with the repair technicians.
The court ordered Samsung Electronics Service to pay the repair technicians the difference in wages between partner company employees and regular employees as 'unpaid wages' and also to pay damages for the illegal dispatch practice.

Initially, about 1,300 repair technicians filed the lawsuit, but after losing in the first trial, many withdrew their claims and some were directly employed, leaving only four repair technicians to continue the lawsuit.
