Private Kindergartens Lose Again in 2nd Trial Over "Edufine" Property Damage Claim
[Asia Economy Reporter Seongpil Cho] The Seoul High Court Civil Division 5 (Presiding Judge Beomsik Seol) announced on the 2nd that it upheld the first-instance ruling in the appeal case where private kindergarten operator Mr. A and others sued the government and education superintendents for damages, claiming financial harm caused by the state-managed accounting system 'Edufine.' Previously, the government mandated the use of the Edufine system for private kindergartens with more than 200 students starting in March 2019, and expanded its use to all private kindergartens from March last year. Mr. A and others filed the lawsuit arguing that the government controls kindergarten finances through the Edufine system and prevents profit-making. The first-instance court dismissed their case, stating, "The Edufine system is unrelated to property ownership and does not restrict the exercise of users' property rights." The appellate court also ruled that the first-instance judgment was appropriate.
