KCTU Gyeongnam Headquarters "Amend Article 11 of the Labor Standards Act Discriminating Against Workers in Businesses with Fewer Than 5 Employees"

View original image[Asia Economy Yeongnam Reporting Headquarters Reporter Lee Sang-hyun] The Gyeongnam branch of the Korean Confederation of Trade Unions held a press conference at 10:30 a.m. on the 13th in front of the Democratic Party of Korea Gyeongnam Provincial Office in Changwon City, Gyeongnam, condemning the "discrimination against workplaces with fewer than five employees."
At the event, the KCTU Gyeongnam Headquarters criticized, "With the full implementation of the substitute holiday system, following the Labor Standards Act, the Serious Accidents Punishment Act, and the Workplace Harassment Act, another discriminatory policy against workers in workplaces with fewer than five employees has been added."
According to Article 11 of the current Labor Standards Act, which defines the scope of application, workplaces with four or fewer regular employees are partially excluded from the application of the Labor Standards Act. Following this principle, workplaces with fewer than five employees are excluded from various labor-related laws.
The KCTU Gyeongnam Headquarters further stated, "The Labor Standards Act, which explicitly excludes workplaces with fewer than five employees, has become a convenient excuse to discriminate against workers' rights in all legal systems," and argued, "Even public holidays should not become polarized holidays."
Finally, they declared, "The KCTU demands a Labor Standards Act that protects all workers and will strongly demand the revision of Article 11 of the Labor Standards Act through a general strike in October."
