After Being Dismissed as Redevelopment Association Head... 50-Year-Old Fined for Welding Office Door and Window
[Asia Economy Reporter Kim Daehyun] A man in his 50s who was accused of welding shut the entrance door and windows of a redevelopment association office after being dismissed from his position as the head of the redevelopment association was sentenced to a fine.
According to the legal community on the 7th, Judge Yang Soeun of the Seoul Central District Court Criminal Division 21 recently sentenced A (56, male), a former redevelopment association head, to a fine of 1 million won on charges of obstruction of business.
The court stated, "The defendant himself admitted to welding the office entrance door and windows to block other association members from entering," and added, "He must have been fully aware that his actions would obstruct business."
Earlier, A was brought to trial on charges of welding shut the entrance door and windows of the redevelopment association office in a district of Dongjak-gu, Seoul, in May last year, preventing acting head B and other staff from entering. Investigations revealed that he had been dismissed from his position as head through a dismissal general meeting resolution within the association the day before the incident.
In court, A's side argued, "There was no intent to obstruct business, and it was a justifiable act." They claimed it was an unavoidable measure to prevent members' personal information and confidential association documents from falling into the opposing party's hands due to an unlawful dismissal general meeting resolution.
However, the court did not accept these claims. The court pointed out, "Even if it was an act to protect members' personal information or internal information, it is difficult to see it as a valid or appropriate means." The court also noted that A filed for a provisional injunction to suspend the effect of the dismissal general meeting resolution against the association but lost the case.

Furthermore, the court stated, "The measure of welding shut the office to prevent B and others from entering was carried out arbitrarily, regardless of the members' will," and added, "There is no concrete evidence that B attempted to misuse internal information unfairly."
