Son with rare disease who insulted mother and beat father... Appeal dismissed
[Asia Economy Reporter Kim Soyoung] A man in his 20s who assaulted his father after the father verbally abused his mother and bit his father's back was sentenced to prison again in the second trial.
According to the court on the 3rd, the Chuncheon District Court's 1st Criminal Division (Chief Judge Kim Cheongmi) dismissed the appeals of both A (26), who was indicted on charges of injury to a lineal ascendant and property damage, and the prosecution, upholding the original sentence of 1 year and 6 months in prison.
A was prosecuted for assaulting his father B (59) in Wonju, Gangwon Province, around 1 a.m. on October 16 last year, repeatedly hitting B's face and head and biting his back with his mouth.
At the time, it was investigated that A committed the crime out of dissatisfaction because B had verbally abused A's mother about three days earlier.
A was also charged with damaging property worth approximately 870,000 won by spraying canned coffee on bedding, a computer case, and wallpaper in a motel room in Wonju on the night of July 25 last year after being refused a refund.
A, who was sentenced to 1 year and 6 months in prison in the first trial, appealed claiming "the sentence is too heavy," while the prosecution appealed arguing "the sentence is too light and unfair," but the second trial court did not accept either appeal.
The second trial court stated, "Although the victims do not wish for the defendant's punishment, the crime of injury to a lineal ascendant involved assaulting the father, who suffers from a rare disease, which goes against human ethics and has a high possibility of social condemnation."

It added, "The defendant has a history of domestic protection orders for assaulting the same victim in the past, but the crimes have become more serious over time, and it seems difficult to fundamentally resolve the conflict at present, so there is a need for a considerable period of isolation."
