Im Seong-geun's Side Submits to Constitutional Court "No Grounds for Impeachment"
[Asia Economy Reporter Choi Dae-yeol] Lim Seong-geun, Chief Judge of the Busan High Court, submitted a response to the Constitutional Court on the 22nd stating that there are "no grounds for impeachment."
According to the legal community, the law firm Minju, which is representing Chief Judge Lim in the impeachment trial, submitted this response to the Constitutional Court on the same day regarding the National Assembly's impeachment motion. Chief Judge Lim is the first in constitutional history to undergo an impeachment trial due to involvement in the so-called judicial scandal case. The law firm Minju includes former Constitutional Court Justice Lee Dong-heup.
The response is reported to be about 30 pages long. It is known to contain the assertion that there are no grounds for impeachment, citing that Chief Judge Lim was acquitted in the first trial on charges related to the judicial scandal (abuse of authority and obstruction of rights). The response also reportedly includes the position that impeachment cannot be based solely on the term "unconstitutional" as stated in the first trial verdict.
The impeachment trial against Chief Judge Lim will officially begin with the first preparatory hearing scheduled for the 26th of this month at the Constitutional Court's small bench. The preparatory hearing generally involves both parties submitting evidence lists and deciding on the method of argument.
