Fast and Convenient Resolution of Defects Disputes in Apartment Complexes... Avoidance Requests for Dispute Committee Members Also Possible
[Asia Economy Reporter Moon Jiwon] Procedures for defect disputes in apartments and other multi-family housing will be improved for greater convenience, and the disqualification and recusal system for members of the Defect Review and Dispute Mediation Committee will be strengthened.
On the 7th, the Ministry of Land, Infrastructure and Transport announced that it will hold an administrative notice from the 8th to the 28th regarding the amendment of the Ministry's directive, "Rules on the Deliberation and Operation of the Defect Review and Dispute Mediation Committee," which applies to the review and mediation procedures related to defects in multi-family housing.
The amendment specifies practical procedures to ensure that the current disqualification and recusal system for committee members is applied more thoroughly.
The committee will verify whether there are grounds for disqualification or recusal of members by the day before the meeting, and members are required to submit a confirmation letter before the meeting. Additionally, parties involved will be given the opportunity to exercise the right to request recusal.
The convenience, speed, and cost-effectiveness of defect dispute procedures will also be improved.
Previously, to prevent abuse of defect disputes, changes or additional applications to the defect dispute requests were restricted; however, going forward, these will be allowed to enhance the convenience of the parties and to enable prompt and economical dispute resolution.
Furthermore, if a party involved wishes to view or copy their case records, they previously had to use the Ministry's information disclosure request procedure, but from now on, they will be able to do so more easily.
Kim Kyunghun, Director of the Housing Construction Supply Division at the Ministry of Land, Infrastructure and Transport, said, "Through this amendment, we expect the fairness, speed, and cost-effectiveness of the defect review and dispute mediation procedures for multi-family housing to be enhanced."
