Yoon Seok-yeol's Side Claims "Prosecutor Disciplinary Act Unconstitutional"... Files Constitutional Complaint and Injunction Request
[Asia Economy Reporter Baek Kyunghwan] The office of Prosecutor General Yoon Seok-yeol has filed a lawsuit claiming that the Disciplinary Committee for Prosecutors Act, which allows the Minister of Justice to form the Disciplinary Committee for Prosecutors, is unconstitutional.
On the 4th, Yoon's lawyer Lee Wankyu stated in a press release, "Article 5, Paragraph 2, Items 2 and 3 of the Disciplinary Committee for Prosecutors Act violate the Constitution as applied to the discipline of the Prosecutor General," and announced that they have filed a constitutional complaint and a provisional injunction to suspend the law's effect with the Constitutional Court.
Lawyer Lee said, "In the disciplinary procedure against the Prosecutor General, the Minister of Justice can both request the discipline and appoint and commission the majority of the disciplinary committee members, thereby constituting more than half of the committee members," adding, "When the Prosecutor General is the subject of discipline, fairness cannot be guaranteed at all."
