After sexually exploiting a 13-year-old child and filming it... Man in his 30s claims "consensual sex" as an excuse
Defendant Claims "Victim Expressed Active Consent"
Court States "Victim's Sexual Values Not Formed"
[Asia Economy Reporter Kim Bong-ju] A man who sexually abused and illegally filmed a 13-year-old girl was sentenced to prison.
On the 25th, the 1st Criminal Division of the Busan Western District Court (Chief Judge Yang Min-ho) sentenced A, a man in his 30s, to three years in prison on charges of violating the Act on the Protection of Children and Juveniles from Sexual Abuse (production and distribution of obscene materials, etc.) and the Child Welfare Act (coercion, mediation, and sexual harassment of a child).
He was also ordered to complete 80 hours of sexual violence treatment programs and was banned from employment at institutions related to children and adolescents for three years.
A approached B (13) through a chat application at the end of January this year and had sexual relations with her several times over two months.
During the sexual encounters, A also illegally filmed B with his mobile phone.
A and his lawyer claimed in court that "the victim actively expressed consent to the sexual relations, so it does not constitute sexual abuse."
However, the court emphasized, "A approached B, whose sexual values had not yet been formed, by introducing his sexual preferences, and committed the acts despite the child expressing severe distress, thus recognizing sexual abuse."
